Terms of Service

1. Acceptance

By accessing any of the Services listed above ("Services"), you agree to these Terms. If you do not agree, do not use the Services.

2. Who we are

Mynd Labs is the operating holding for intelligence-infrastructure products built and operated by Barış Esmer ("we", "us"). Each sub-brand may carry additional product-specific terms referenced inline below.

3. Permitted use

You may use the Services for personal or commercial purposes within the scope of any explicit subscription, license, or evaluation agreement. You may not:

• Reverse-engineer, scrape at high volumes, or attempt to extract proprietary data, models, or signal infrastructure.
• Resell, sublicense, or republish substantial portions of the content without written permission.
• Use the Services to harass, defame, infringe rights, or violate applicable law (Turkish, EU, or your local jurisdiction).
• Attempt to disrupt the Services, abuse rate limits, or impair availability for other users.

4. Accounts and authentication

When you sign up for Mynd Platform or CommPass, you are responsible for keeping your credentials secure and for all activity under your account. Notify us immediately if you suspect unauthorized use.

5. Content and intellectual property

All Mynd Labs branding, software, written content, and visual design remains our property. Content you submit (e.g., quiz answers, lead information in CommPass) remains yours; you grant us a limited licence to process it solely to provide the Services.

6. Investment migration disclaimer

Mynd Migration, the Strategic Optionality Test, country guides, and related calculators are informational only. They do not constitute legal advice, immigration advice, tax advice, or investment advice. Programs, costs, and timelines change without notice. Always consult a licensed advisor in the relevant jurisdiction before making decisions.

7. CommPass and Mynd Platform — operating customer terms

If you use CommPass or Mynd Platform as a paying operator (advisor, broker, immigration team), the data you ingest about your own end customers is processed by us as a Data Processor under GDPR Article 28 / KVKK equivalents. You remain the Data Controller. A Data Processing Addendum is available on request to hello@myndlabs.io.

8. Disclaimers

The Services are provided as is and as available. We do not warrant uninterrupted operation or that all information is error-free. To the fullest extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose.

9. Limitation of liability

To the maximum extent permitted by Turkish law and equivalent local law, our aggregate liability for any claim arising out of the Services is limited to the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater. We are not liable for indirect, consequential, or lost-profit damages.

10. Governing law

These Terms are governed by the laws of the Republic of Türkiye. Disputes are subject to the exclusive jurisdiction of the Muğla courts and enforcement offices. EU/EEA consumers retain mandatory consumer-protection rights under their local law.

11. Changes

We may update these Terms. Material changes are announced at the top of this page. Continued use after a change constitutes acceptance.
